5. How We Use Health-Related Information

We use health-related information only as reasonably necessary to provide requested services, communicate with you, maintain records, and operate our business. We do not sell health-related information. We do not use health-related information for targeted advertising.

6. How We Share Information

We do not sell your personal information. We share information only as described below.

A. With Your Direction or Authorization

We may share information with people or organizations you ask us to contact, including family members, caregivers, attorneys, financial advisers, financial institutions, insurance agents, care managers, providers, hospitals, facilities, pharmacies, government agencies, or community organizations.

B. With Service Providers

We may share information with vendors that help us operate our business, including scheduling, video conferencing, transcription or note-taking services; website hosting and analytics provider; and IT, security, accounting, legal, and professional service providers. We ask service providers to use information only to provide services to us and to protect the information appropriately.

D. Business Transfers

If SilverStead is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, information may be transferred as part of that transaction, subject to appropriate confidentiality protections.

7. Call and Meeting Recording

Our consulting work depends on accurately capturing what you tell us about your situation and your family member’s needs. To support this, we may record and transcribe phone calls, video calls, online meetings and in-person meetings with participant consent.

How we obtain consent. Because we are based in Illinois, and because participants on a call may be located in other states with different recording and consent laws, we ask each participant on a call or meeting, including in-person meetings, to consent to the recording and transcription. We ordinarily address recordings and transcripts in our written engagement materials and confirm verbally at the start of each call or meeting that the call or meeting is being recorded and that participants consent before substantive discussion begins. If any participant does not consent, we will not record and transcribe. If you ask us to stop recording and transcription during a call or meeting, we will stop. By continuing with a recorded and transcribed call or meeting after receiving notice, you consent to the recording and transcription.

Participants you bring to the call. If you invite family members, caregivers, or other people to join a call or meeting with SilverStead, please let them know in advance that the call or meeting may be recorded and transcribed so consent can be confirmed at the start.

How we use and store recordings and transcripts. Recordings and transcriptions may contain personal information, health-related information, family information, financial information, insurance information, or other sensitive information. We use recordings and transcriptions to provide services, prepare notes, maintain accurate records, and improve quality. Recordings,  transcripts or summaries generated from them are stored in access-controlled accounts used by SilverStead personnel and are retained as described in Section 10.

8. Cookies and Analytics

Our website may use cookies and similar technologies to operate the website, remember preferences, understand website traffic, improve services, and protect security. You may be able to control cookies through your browser settings. If you disable cookies, some website features may not work properly.

9. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, disclosure, alteration, and loss.

However, no method of transmission or storage is completely secure. Please do not send highly sensitive information by unsecured email or text message unless you understand and accept the risk.

10. Data Retention

We keep information for as long as reasonably necessary to provide services, maintain business records, comply with legal and tax obligations, resolve disputes, enforce agreements, and protect our rights. Engagement files may include  notes, recordings, transcripts, summaries, correspondence and other materials related to the services we provide and are generally retained for the duration of the engagement and for a reasonable period afterward consistent with our records retention practices. We may keep information longer when required by law or to resolve disputes.

We may delete, de-identify, or aggregate information when it is no longer needed.

  • Correct inaccurate information;

  • Delete information, subject to legal and operational limits;

  • Stop using certain contact methods;

  • Opt you out of marketing communications; and

  • Discuss whether certain information can be excluded from call recordings or notes.

We may need to verify your identity before responding to a request. We may decline a request where permitted or required by law, such as where information must be retained for legal, tax, security, dispute, or service-record purposes.

12. Communications

We may send you service-related communications, including scheduling messages, follow-up notes, invoices, administrative updates, and responses to inquiries. These are not marketing messages.

If we send marketing emails, you may opt out by using the unsubscribe link or contacting us.

13. Information About Other People

Our services often involve information about aging parents, spouses, siblings, caregivers, and other third parties. Please share only information that is relevant to the services requested and that you are authorized or permitted to share.

If a parent or loved one has legal authority over their own affairs, you may need their consent before requesting that we contact providers, plans, facilities, or other third parties on their behalf.

14. Children

Our website and services are intended for adults. We do not knowingly collect personal information from children under 13.

15. State Privacy Rights

Depending on where you live, you may have additional privacy rights under state law. We will respond to applicable requests as required by law.

Because our clients and their aging parents may be located in different states, state-specific privacy, recording, health information, consumer protection, and breach notification laws may apply depending on the facts.

16. Health Data Breach Considerations

SilverStead is not a HIPAA covered entity, but certain non-HIPAA health information may still be subject to federal or state breach notification requirements in some circumstances.

If we determine that a security incident requires notice under applicable law, we will provide notice as legally required.

17. Changes to This Privacy Notice

We may update this Privacy Notice from time to time. The updated version will be posted on our website with the updated effective date. Your continued use of our website or services after an update means the updated Privacy Notice applies going forward.
